HeirBornMusic.net Terms of Service/ Non-exclusive lease & Exclusive License Agreement
This site is owned and operated by HeirBornMusic.net and contains material that is the legal property of HeirBornMusic.net, both of who actively and aggressively enforces its intellectual property rights to the fullest extent of the law. You may not modify, copy, reproduce, publish, upload, post, distribute, transmit or in any way exploit any material from this site, including code and software. Without limiting the generality of the foregoing, unless expressly authorized by written and signed consent of Uriah Eli Jackson (“Producer”) you may not distribute any part, feature or element of this site over any network, including a local area network, nor sell no offer it for sale. This site (including, but not limited to, text, content, photographs, graphics, video and audio content) is protected under the copyright laws of the United States and under international law. HeirBornMusic.net is specially designed to allow users to purchase beats exclusively created by Producer. ANY UNAUTHORIZED PRESENTATION, MODIFICATION OR RECASTING OF THIS SITE IS EXPRESSLY PROHIBITED.
All product names, and company names or logs displayed on this site are the property of their respective owners.
All beats on HeirBornMusic.net are owned by Producer. Users are only able to purchase and download beats on this site. By purchasing a beat they are able to utilize for mixtapes, demos, albums, and performance. Purchasers are allowed to sell up to two thousand (2000) copies before they will have to contact email@example.com to re-release the beat for additional permission usage. In the event that tracks created with any of the beats purchased from HeirBornMusic.net are eligible to be commercialized (airplay on radio, television, commercial, motion picture, ect.) purchasers are required to contact firstname.lastname@example.org for permission usage.
Leasing rights allows the user to use the beat for a mixtape, demo, album or performance. This recording can then be distributed at a price at their discretion for up to 2,000 copies. Selling more than 2,000 copies means the user must acquire renewal of a non-exclusive lease for the beat. User may also use the beat for non-profit promotional use or demos. Upon purchase, user will have full rights to record, alter, mix the beat/song in any shape, way, or form (except reselling the beat). Upon request, a user may receive a contract in the mail granting a non-exclusive right to the purchased beat. In the event that someone buys exclusive rights to the beat a user has leased, any previous buyers rights shall stand and the beat is still theirs to use. A user may also acquire new leasing rights if you sell more than 2,000 copies since their contract predates exclusive sale. The seller will not receive a royalty from the sale of records or downloads. Any user must however give full credit to the seller (producer Uriah Eli Jackson and company HeirBornMusic.net) on all commercial recordings. Upon purchasing leasing rights, the seller still owns the beat(s) and the seller is able to resell the beat(s) to any other party until exclusive rights have been purchased.
HeirBornMusic.net’s producer cannot reserve exclusive beats for customers. Since there are others who may wish to purchase the exclusive rights to the beat, naturally, the beat would go to the one who pays for it first. We do not “hold” beats or guarantee that the beat will be available to anyone. The status of availability of any beats on HeirBornMusic.net may change without notice. Any non-exclusive beat on HeirBornMusic.net can be sold exclusively without notice to anyone. Exclusive beats may have been leased out prior to purchase of exclusive rights. At the time the buyer purchases the exclusive rights to a beat, the beat will no longer be available for purchase through non-exclusive lease or exclusive rights. The beat will be removed from HeirBornMusic.net website. Whatever leases that are still pending on the beat will remain in effect until the lease has sold 2,000 copies of a project containing the musical composition.
Buyer does have the worldwide, exclusive, transferable right for the use of the Music as long as additional audio/visual performances are recorded with our musical compositions (hereinafter referred to as “synchronization”) The Buyer is granted permission to sell or broadcast only in synchronization or mechanical reproduction with other visual or audio performances (vocals) added by Buyer. Rights include distribution of phono-record demos created using the Producer compositions. Buyer has distribution, performance and radio rights as long as they adhere to the following restrictions. Buyer understands that the rights that are being granted to the Buyer in this Agreement are exclusive and that the Seller will have the no authority and no right to issue other parties the right to use the Original Instrumental Composition that is being licensed in this agreement.
1) The Buyer understands that they are responsible for clearing all samples that they choose to use and that the Seller cannot and will not be held liable for the misuse of any sampled material that the Buyer uses in conjunction with the Original Instrumental Composition that is being licensed in this agreement.
2) Buyer cannot resell, lease or license any compositions to another user.
3) Buyer must supply the Producer with at least 1 copy of each final recording made using the Producer’s Music.
4) Buyer must include on all productions the producer’s name. Buyer agrees to display this statement on all physical media containing a portion or sum of the Original Instrumental Composition that is being licensed in this agreement. Including but not limited to CD’s, CD covers, Cassette tapes, Cards, etc.
5) Use of the Seller’s compositions in isolation (without synchronization of vocal performance) is not permitted without written consent from the Seller
By purchasing exclusive beats from HeirBornMusic.net, the buyer hereby agrees to this agreement.
ALL SALES ARE FINAL.
